);\">Hace 50 a\u00f1os nace la Empresa Municipal de Agua Potable y Alcantarillado de Ambato (EMAPA), mediante la ordenanza suscrita el 30 de junio de 1967.<\/span><\/p><p style=\"outline-style: none; outline-width: initial; margin-bottom: 20px; font-style: normal; font-variant-numeric: inherit; font-variant-east-asian: inherit; font-weight: 400; font-stretch: inherit; line-height: inherit; font-size: 15px; text-align: justify;\">La misma fue reformada con la ordenanza sustitutiva de Constituci\u00f3n publicada en Registro Oficial 350 del 8 de enero de 1990; y, el 3 de junio del 2010 se constituye como Empresa P\u00fablica-Empresa Municipal de Agua Potable y Alcantarillado de Ambato (EP-EMAPA-A), con la ordenanza de su creaci\u00f3n que fue discutida y aprobada en seis sesiones ordinarias realizadas entre abril, mayo y junio del mismo a\u00f1o.<\/p><p style=\"outline-style: none; outline-width: initial; margin-bottom: 20px; font-style: normal; font-variant-numeric: inherit; font-variant-east-asian: inherit; font-weight: 400; font-stretch: inherit; line-height: inherit; font-size: 15px; text-align: justify;\">Las necesidades de la sociedad en espacio y tiempo son determinantes en la construcci\u00f3n de paradigmas que fijan precisamente el desempe\u00f1o de \u00e9sta sociedad y de sus imaginarios de servicios que son plasmados en leyes y normas de convivencia, expresadas por la voluntad de los representantes elegidos por el soberano.<\/p><p style=\"outline-style: none; outline-width: initial; margin-bottom: 20px; font-style: normal; font-variant-numeric: inherit; font-variant-east-asian: inherit; font-weight: 400; font-stretch: inherit; line-height: inherit; font-size: 15px; text-align: justify;\">La historia jur\u00eddica de la EMAPA tampoco es ajena a este factor sociol\u00f3gico y ciertamente antropol\u00f3gico en la construcci\u00f3n de las leyes y normas que determina su evoluci\u00f3n hist\u00f3rica en la prestaci\u00f3n de servicios sanitarios que garanticen acceso al agua potable y los sistemas de alcantarillado hasta los grandes colectores y la urgencia de la planta de tratamiento de agua residuales, proyectos expresados en el tiempo incluso por los cambios de h\u00e1bitos y comportamientos humanos.<\/p><p style=\"outline-style: none; outline-width: initial; margin-bottom: 20px; font-style: normal; font-variant-numeric: inherit; font-variant-east-asian: inherit; font-weight: 400; font-stretch: inherit; line-height: inherit; font-size: 15px; text-align: justify;\">Igualmente la visi\u00f3n nacional de la construcci\u00f3n de leyes forma parte de este contexto, considerando por ejemplo dos grandes cuerpos normativos hist\u00f3ricos que conducen la gesti\u00f3n hist\u00f3rica del municipalismo, debatida entre la Ley de R\u00e9gimen Municipal, generadora de normas b\u00e1sicas que desarrollaron las competencias municipales, son considerados en \u00a0el desarrollo diferenciado que cada territorio adquiere por sus condiciones de liderazgo, actividad social, econ\u00f3mica y otras que aceleraron o mermaron su ritmo de crecimiento.<\/p><p style=\"outline-style: none; outline-width: initial; margin-bottom: 20px; font-style: normal; font-variant-numeric: inherit; font-variant-east-asian: inherit; font-weight: 400; font-stretch: inherit; line-height: inherit; font-size: 15px; text-align: justify;\">Con la Constituci\u00f3n de Montecristi y los intentos propios de \u00a0la modernizaci\u00f3n del estado, se vuelven vitales en el conjunto de leyes que complejizan la actual visi\u00f3n del municipalismo: el C\u00f3digo Org\u00e1nico de Organizaci\u00f3n Territorial Autonom\u00edas y Descentralizaci\u00f3n (COOTAD), el C\u00f3digo de Planificaci\u00f3n y Finanzas P\u00fablicas, Ley de Empresas P\u00fablicas y otras m\u00e1s sociales como la Ley Org\u00e1nica de Participaci\u00f3n Ciudadana son parte de esa nueva estructura territorial del municipalismo y el ejercicio de competencias hist\u00f3ricas y otras que se enmarcan dentro del R\u00e9gimen Nacional de Planificaci\u00f3n, R\u00e9gimen del Buen Vivir y otros instrumentos de planificaci\u00f3n local como el Plan de Desarrollo y Ordenamiento Territorial, que reemplazaron a otros planes menores y m\u00e1s limitados en sus objetivos como los planes de Desarrollo Urbano.<\/p><p style=\"outline-style: none; outline-width: initial; margin-bottom: 20px; font-style: normal; font-variant-numeric: inherit; font-variant-east-asian: inherit; font-weight: 400; font-stretch: inherit; line-height: inherit; font-size: 15px; text-align: justify;\">De esa manera se perdi\u00f3 el concepto rom\u00e1ntico del Ilustre Municipio de Ambato para pomposamente llamarlo Gobierno Aut\u00f3nomo Descentralizado Municipalidad de Ambato (GADMA), con lo que la EMAPA, en ese proceso naci\u00f3 como empresa municipal luego de ser el departamento de agua potable y alcantarillado del municipio hasta convertirse en empresa p\u00fablica con toda su capacidad administrativa y financiera de manera aut\u00f3noma.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section la Administraci\u00f3n del alcalde de Ambato Ricardo Callejas V\u00e1sconez, entre 1967-1970, se cre\u00f3 el Departamento de Agua Potable y Alcantarillado que depend\u00eda directamente del Municipio.<\/span><\/p><p style=\"outline-style: none; outline-width: initial; margin-bottom: 20px; font-style: normal; font-variant-numeric: inherit; font-variant-east-asian: inherit; font-weight: 400; font-stretch: inherit; line-height: inherit; font-size: 15px; text-align: justify;\">El director de la unidad fue el ingeniero Germ\u00e1n Chac\u00f3n Bucheli, destacado profesional qui\u00e9n con una visi\u00f3n amplia fue el gestor para que se constituya la Empresa Municipal de Agua Potable y Alcantarillado de Ambato (EMAPA), con el prop\u00f3sito de garantizar la administraci\u00f3n, operaci\u00f3n y funcionamiento de todos los sistemas de agua potable y alcantarillado que brindaban en aquella \u00e9poca una cobertura muy limitada en la ciudad.<\/p><p style=\"outline-style: none; font-size: 15px; text-align: justify;\">Es as\u00ed, que en base a la Ordenanza de Constituci\u00f3n aprobada por el Municipio de Ambato en las sesiones del: 3 de abril, 22 de mayo y 15 de junio de 1967, se aprueba la constituci\u00f3n de la Empresa Municipal de Agua Potable y Alcantarillado (EMAPA), seg\u00fan decreto firmado el 30 de junio del mismo a\u00f1o.<\/p><p style=\"outline-style: none; outline-width: initial; margin-bottom: 20px; font-style: normal; font-variant-numeric: inherit; font-variant-east-asian: inherit; font-weight: 400; font-stretch: inherit; line-height: inherit; font-size: 15px; text-align: justify;\">La EMAPA inici\u00f3 su trabajo en beneficio de la colectividad con limitados recursos econ\u00f3micos. Realiz\u00f3 estudios de fuentes de captaci\u00f3n y conducci\u00f3n, tanto superficiales como subterr\u00e1neas, para cubrir la creciente demanda de agua potable. En un principio se suministr\u00f3 el servicio de l\u00edquido vital a un peque\u00f1o sector del centro de la ciudad.<\/p><p style=\"outline-style: none; outline-width: initial; margin-bottom: 20px; font-family: inherit; text-align: justify; color: var( --e-global-color-text );\">Luego de la reforma de la Ordenanza Sustitutiva de Constituci\u00f3n de la EMAPA publicada en el Registro Oficial N-350 del 8 de enero de 1990, la EMAPA continu\u00f3 su paulatino camino en busca de su autonom\u00eda definitiva\u00a0 que alcanza con la aprobaci\u00f3n de la Ordenanza de Creaci\u00f3n de la Empresa P\u00fablica Municipal de Agua Potable y Alcantarillado de Ambato, el 21 de julio del 2010, con su publicaci\u00f3n en el Registro Oficial N-240.<\/span><\/p><p style=\"outline-style: none; outline-width: initial; margin-bottom: 20px; font-style: normal; font-variant-numeric: inherit; font-variant-east-asian: inherit; font-weight: 400; font-stretch: inherit; line-height: inherit; font-size: 15px; text-align: justify;\">El art\u00edculo 1 establece la constituci\u00f3n y domicilio de la nueva empresa p\u00fablica municipal conformada en base al marco jur\u00eddico de la Ley Org\u00e1nica de Empresas P\u00fablicas, que otorga: \u201cpersoner\u00eda jur\u00eddica de derecho p\u00fablico con autonom\u00eda administrativa, operativa, financiera y patrimonial\u201d, aunque todav\u00eda bajo normas generales de la Ley de R\u00e9gimen Municipal que fue derogada en octubre del mismo a\u00f1o con la vigencia del C\u00f3digo Org\u00e1nico de Organizaci\u00f3n Territorial Autonom\u00edas y Descentralizaci\u00f3n (COOTAD).<\/p><p style=\"outline-style: none; outline-width: initial; margin-bottom: 20px; font-style: normal; font-variant-numeric: inherit; font-variant-east-asian: inherit; font-weight: 400; font-stretch: inherit; line-height: inherit; font-size: 15px; text-align: justify;\">Contrario a la primera ordenanza constitutiva en empresa municipal, los temas ambientales est\u00e1n fuera del imaginario legislativo, en la finalidad de creaci\u00f3n de la empresa p\u00fablica municipal ratifica la gesti\u00f3n para \u201cdotar servicios de agua potable y alcantarillado, seg\u00fan el Pla de Ordenamiento Territorial de Ambato, (\u2026) participar\u00e1 en el control de las cuencas hidrogr\u00e1ficas aprovechables para la protecci\u00f3n de los ecosistemas productores de recursos h\u00eddricos\u201d.<\/p><p style=\"outline-style: none; outline-width: initial; margin-bottom: 20px; font-style: normal; font-variant-numeric: inherit; font-variant-east-asian: inherit; font-weight: 400; font-stretch: inherit; line-height: inherit; font-size: 15px;
